The victim of this violent crime had a criminal record, and the defendants thought that would help them escape liability for failing to protect their tenants and guests from known criminal threats. During litigation, we discovered video evidence of rampant and unchecked gang activity on the property. While the insurance company claimed their policy didn’t cover the tragic death, we won a declaratory judgment action from the court that stated otherwise. Despite the victim’s criminal record, a $3.7 million judgment proves that property owners have an obligation to take reasonable steps to make their property safe for everyone who has a valid reason to be there, and just because someone made mistakes in the past doesn’t mean their lives don’t have value.
Only the survivors of violent crimes or the families of victims can use the civil court system to hold property owners and managers accountable when they fail to take reasonable precautions to protect tenants and guests from known threats. By holding them accountable, we can motivate property owners to make meaningful changes to prevent violent crime from happening to others. In that way, together, we can help Make Atlanta Safe.
